Payment Authorization Agreement
Auction houses must provide a valid credit card on file to sell on LiveAuctioneers.
LiveAuctioneers will invoice Client for all services rendered on a monthly basis, and payment shall be due and remitted within thirty (30) days of the invoicing date. It is understood and agreed that in the unlikely event that Client’s outstanding balance remains unpaid for more than 30 days, LiveAuctioneers shall have the right to charge the outstanding balance to Client’s credit card number on file. In the further event of a credit decline, LiveAuctioneers shall have the right to commence a collection proceeding/action against Client for the sum owed, and shall be entitled to collect its collection costs and expenses incurred as a result thereof, including, but not limited to, its attorney fees and court costs. Additionally, LiveAuctioneers reserves the right to assess finance charges at a rate of 1% per month on all outstanding balances that remain unpaid for more than 30 days.
Additionally, in the event that the Client’s outstanding balance remains unpaid for more than 30 days, it is understood and agreed that Client shall forfeit its account privileges, including, but not limited to, its right to access its account and any information contained therein, and its right to post additional catalogs on liveauctioneers.com
Further, in the event Client lists any items for auction or sale on any competing platform or competitor of LiveAuctioneers during the next twelve (12) months, Client agrees that LiveAuctioneers shall have the right, but not the obligation, to list such items for auction and/or sale, as relevant, on LiveAuctioneers' website on terms, as viewed from LiveAuctioneers' perspective, no less favorable than those offered to the competing platform or competitor.
Client understands that authorization will remain in effect until the Client cancels it in writing, and Client agrees to notify LiveAuctioneers in writing of any changes or termination of this authorization at least 15 days prior to the next billing date.
